With reference sheets, you need to provide the following details.
- Name
- Species
- Age
- Height (assume standard pony height is 5 feet tall or 150 cm, hooves to head, not withers)
- Gender
- Other important details (that are not visible at first glance)
In case with NSFW reference sheets:
- Downstairs size (standard pony's measurements are about 20 inches length or 50 cm, and 4 inches in diameter or 10 cm)


MUSIC COMMISSIONS

Mixing and Mastering

$70 per song

The song should be archived with separate tracks, that is, everything should be recorded on different tracks, there should be no back-vocals in the track with the main vocals, etc. Tracks should not clip, naturally. Export the "dry" tracks of the project (without frequency, dynamic and spatial treatments), leaving only the author's effects that you would not like to change (if they are present).Also describe the style or example of the track (reference) that your track should sound like (if you don't do this, then I'm mixing and mastering based on my vision). And specify the key and BPM (number of beats per minute) of your track.Naturally, the sound should be clean, the vocals should be tuned (Melodyne or Newtone are suitable for this). Melodyne is a separate program, and Newtone is a plugin for FL Studio.Drums should be separate tracks as well:
Kick - one mono track
Snare - one mono track
Toms - one stereo track
Cymbals - one stereo track
If there are no drums, I can program in software ones, in which case I will need a MIDI from you.Guitars are best ready-made with your preferred amplification, but if there is a need, provide a clean DI and wishes for the sound, I can reamp the guitars. If ready-made, then send them without reverb or delay.

You must provide a detailed description of the desired song, including the genre, mood, theme, and any specific references or inspirations. You will have the opportunity to request changes during this phase.

SERVICES OFFERED

The Artist provides the following services, defined without ambiguity:Digital Art: Creation of original 2D illustrations, character designs, backgrounds, and visual assets.Mixing/Mastering: Audio post-production, including track balancing, technical polishing, and format optimization for distribution.Full Song Production: End-to-end music creation, including composition, arrangement, recording, mixing, and mastering.

GENERAL TERMS

Agreement Acceptance:
Commission initiation constitutes unconditional acceptance of these Terms. All prior negotiations are superseded by this document.
Eligibility:
Client affirms they are 18+ years old at time of order. No exceptions.
Client affirms they are legally allowed to request and possess the commissioned content. The Artist is not responsible for misuse or illegal distribution.
Communication Protocol:
Exclusive Channels: Discord, or Telegram.
Formal Requests: Commission starts only via Google Form submission.Response Window: 3 business days (UTC+3).Client Obligations:
Provide complete visual/textual references upfront.
Disclose deadlines exceeding 30 calendar days during ordering. Rush fees apply (25% surcharge).
Confidentiality requests (private commissions) require written notification before work begins.
Professional Conduct Requirement:
The Artist reserves the right to terminate any commission and refuse future business if the Client engages in:
Excessive nitpicking (excessive revision requests per stage beyond included revisions)
Disrespectful communication (e.g., barking orders, threats, or harassment)
Consistent frustration of the workflow (e.g., excessive unsubstantiated change requests after final approval)
Terminated commissions under this clause follow the refund policy in a section below.

PAYMENT TERMS

Pricing Structure:
Base prices listed publicly. Adjustments apply for:
Complex designs (e.g. intricate robotics, multiple sets of limbs).
Missing reference materials (+20% fee).
Private commissions (+25–100% fee; see below).
Payment Schedule:
100% upfront via PayPal or Boosty (Russian clients: Tinkoff Bank).
Payment Plans: Available for projects >$500Refund Policy:
All sales are final. Payments cannot be refunded under any circumstances except as outlined below.
Sole Exception (Artist's Discretion):
1. The Artist is unable or unwilling to complete the work due to:
1.1. Client harassment, threats, or discriminatory behavior.
1.2. Client violating these Terms (e.g., demanding prohibited content).
1.3. Client causing unreasonable delays (>30 days unresponsive).
The refund amount will be proportional to work not completed (e.g., 30% refund if canceled during line art).
2. No Refunds For:
2.1. Change of mind, dissatisfaction with style/quality.
2.2. Client's failure to provide adequate references or feedback.
3. Dispute Resolution:
3.1. Chargebacks or payment reversals will be contested with evidence of this policy.
3.2. Clients attempting chargebacks forfeit all rights to the work and may face legal action for fraud.

PROCESS & REVISIONS

Workflow Stages:
1. Sketch Approval: Any major changes included.
2. Draft Delivery: Minor adjustments (color/fine detail only).
3. Final Delivery: No structural/design changes permitted.
Revision Limits:
Major Changes (e.g., pose, composition): $10 fee after sketch approval.
Client Delay: >7 days inactivity forfeits revision rights.
Delivery:
Art: PNG (2500 px / 72 dpi) via Discord/Telegram.
Music: MP3 via messaging; WAV/FLAC via Dropbox/Google Drive.
Deadlines:
Estimated completion date provided upfront. Force majeure (including but not limited to: illness, war, natural disaster, platform outages exceeding 7 days, or unexpected hospitalization) exempts liability.

INTELLECTUAL PROPERTY

Artist Rights:
Retains copyright, display rights, and portfolio usage unless Private Commission (see below).
May livestream/create process content unless explicitly prohibited.
Retains rights to sell, exhibit, or license the work independently.
Client Rights:
Personal Use License: Non-commercial sharing with credit (©Jacqueling).
Prohibited: AI training, NFTs, unapproved edits, or any form of monetization.
Non-Exclusive Commercial License (optional):
Must be requested before payment and noted in the commission form.
May reproduce and sell the work (e.g., stickers, prints, apparel).
Cannot claim exclusive ownership or prevent Artist from commercial use.
No royalty or profit-sharing required.

PRIVATE COMMISSIONS & CONTENT POLICY

Private Commissions:
Definition: Confidential artwork that will not be displayed in the Artist's portfolios.
Surcharge: +25–100% (based on content).
Must be requested pre-payment.
Prohibited Content:
Underage subjects in NSFW contexts (including diapers/ABDL).
Art promoting real-world racism, racial supremacy, hate speech, or depicting fictional races in a manner clearly analogous to real-world racist ideologies.
Dubious consent (dubcon) is permitted only in clearly fictional contexts where implied or eventual consent is evident, but clear non-consent (non-con) is prohibited.
Gore, vore (hard), or sexualized violence.
Style Restrictions:
Humans (non-furry) or "Equestria Girls"-style characters. Exception if there's a furry character present (e.g., anthro on human, feral on human art).
Allowed Content:
The following themes are not only allowed, but enthusiastically welcomed. These subjects align with the Artist's style, interests, and specialty — discounts may apply at the Artist's discretion:
Kinks: BDSM, hyper-anatomy, fisting, musk, soft vore.
Characters: Furry ferals, MLP, Pokémon, monsters.
All content must comply with applicable laws in both the Artist's and Client's jurisdictions. The Client assumes full legal responsibility for the subject matter of the commission.

ACKNOWLEDGMENT

Client Duty: Check terms before each commission.Significance: By commissioning, Client attests they:
Read and understood all sections.
Waive rights to claim ignorance of terms.
